Agreement and provider
This End User License Agreement (“EULA”) is a direct agreement between you and Cedar Theory LLC (“Cedar Theory,” “we,” “us,” or “our”) for the Android application Mahjong Trainer, package com.cedar.mahjongtrainer, including its content, documentation, and updates (collectively, the “App”). Google is not a party to this EULA.
By installing, accessing, or using the App, you accept this EULA. If you do not accept it, do not install or use the App. Your use is also subject to the Android Terms of Use and applicable Google Play terms.
License grant
Subject to this EULA, the Android Terms of Use, and applicable law, Cedar Theory grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use one copy of the App on Android devices you own or control, or on devices otherwise permitted by Google Play, solely for your personal, non-commercial educational use.
The App is licensed, not sold. No rights are granted except those expressly stated in this EULA.
License restrictions
You may not, and may not help another person to:
- copy, distribute, rent, lease, lend, sell, sublicense, publish, or commercially exploit the App or its content;
- modify, adapt, translate, create derivative works from, reverse engineer, decompile, disassemble, or attempt to obtain the App’s source code, except to the limited extent applicable law expressly permits despite this restriction;
- remove or alter copyright, trademark, attribution, or other proprietary notices;
- bypass or interfere with subscription checks, access controls, security features, Google Play Billing, or technical limits;
- use the App unlawfully, fraudulently, to infringe another person’s rights, or in a way that damages or disrupts the App or a third-party service; or
- use the App or its content to build, train, benchmark, or improve a competing commercial product or service without our written permission.
Ownership and reserved rights
Cedar Theory and its licensors retain all right, title, and interest in the App, including its software, design, text, lessons, exercises, graphics, audiovisual material, trademarks, and other intellectual property. This EULA does not transfer ownership of the App or any intellectual property right to you. All rights not expressly granted are reserved.
Updates and compatibility
Cedar Theory may provide updates, corrections, security fixes, new features, or modified content. Updates may be downloaded and installed automatically through Google Play according to your device and store settings. An update may change or remove features and may be required for continued use.
We do not promise compatibility with every device, Android version, or future operating system. This EULA applies to updates unless an update comes with a separate license.
Google Play and third-party services
The App uses Google Play services, including Google Play Billing, to offer and verify subscriptions. Google’s terms and privacy policy govern Google’s services. Cedar Theory is responsible for the App and its support; Google has no obligation to provide maintenance or support for the App.
The App may open third-party pages, such as Google Play subscription management or this legal and support website. Third-party services are controlled by their providers and may change or become unavailable. Cedar Theory is not responsible for third-party content, services, policies, or transactions, except to the extent applicable law requires.
Subscriptions and purchases
Premium access may be offered through the Google Play subscriptions mahjongtrainer.subscriptions.monthly and mahjongtrainer.subscriptions.annual. Purchases, trials, renewal, cancellation, restoration, refunds, and plan replacement are governed by the subscription provisions in the Android Terms of Use and applicable Google Play terms.
Privacy
The App does not require an account and is designed to keep learning data on your device. The Android Privacy Policy explains local storage, Android permissions, Google Play Billing data, support communications, website logs, retention, and your choices.
Disclaimers
Mahjong Trainer is an educational practice tool. American Mahjong rules, card interpretations, conventions, and tournament decisions may vary by publication, league, year, table, or organizer. The App is not a substitute for the official rules governing a particular game, and we do not guarantee any specific learning, competition, or gameplay result.
To the fullest extent permitted by law, the App is provided “as is” and “as available,” with all faults and without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components. Nothing in this EULA excludes a warranty or consumer right that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, Cedar Theory and its owners, officers, employees, contractors, licensors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, goodwill, or opportunities, arising from or related to the App or inability to use it, even if advised that such damages were possible.
To the fullest extent permitted by law, Cedar Theory’s aggregate liability arising from or related to the App will not exceed the greater of the amount you paid for the App or its subscriptions during the 12 months before the event giving rise to liability or US $25. These limitations apply to all theories of liability. They do not apply where prohibited, including to liability that cannot legally be limited.
Indemnity where lawful
To the extent permitted by applicable law, you will defend, indemnify, and hold harmless Cedar Theory and its owners, officers, employees, contractors, licensors, and suppliers from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your unlawful use of the App, your material breach of this EULA, or your violation of another person’s rights. This obligation does not apply to the extent a claim results from Cedar Theory’s own misconduct or where consumer law prohibits the obligation.
Termination
This EULA remains effective until terminated. You may terminate it by stopping use and uninstalling the App. Your license terminates automatically if you materially breach this EULA. On termination, you must stop using and delete the App.
Termination of this license does not itself cancel a Google Play subscription; you must cancel through Google Play. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, indemnity, and applicable law—will survive.
Applicable law
This EULA is governed by applicable law, without regard to rules that would require application of another jurisdiction’s law. Nothing in this EULA deprives you of mandatory consumer protections or rights available under the law of your usual residence. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before starting a formal dispute, you and Cedar Theory agree to make a reasonable good-faith effort to resolve it by email, unless applicable law permits either party to proceed immediately. Any court proceeding must be brought in a court with lawful jurisdiction over the parties and dispute.
Changes to this EULA
We may update this EULA to reflect changes to the App, services, or law. We will post the revised EULA on this page and update the effective date. Where required, we will provide additional notice or request consent. Continued use after a revised EULA becomes effective constitutes acceptance to the extent permitted by law; otherwise, you must stop using the App.
